Emprunter ou obtenir un crédit quand on est malade – la convention AERAS

Emprunter de l’argent ou demander un crédit quand on est malade peut s’avérer encore plus difficile que quand on est en bonne santé.

L’organisme qui donne le crédit demande en effet de souscrire une assurance emprunteur pour garantir le prêt . C’est une sécurité pour l’emprunteur et pour sa famille, c’en est une aussi pour le prêteur : en cas de décès ou d’invalidité de l’emprunteur, c’est l’assurance qui rembourse l’établissement de crédit.

Pour aider ceux qui ne peuvent pas obtenir facilement l’assurance emprunteur à cause de leur état de santé, les pouvoirs publics ont mis au point la convention AERAS.

La convention AERAS vous concerne si votre état de santé ne vous permet pas d’obtenir une couverture d’assurance aux conditions standard du contrat (c’est-à-dire sans majoration de tarif ou exclusion de garanties).

L’objectif de la convention est de faciliter l’accès à l’assurance et à l’emprunt des personnes ayant ou ayant eu un problème de santé.

La convention AERAS concerne, sous certaines conditions, les prêts à caractère personnel (prêts immobiliers et certains crédits à la consommation) et professionnel (prêts pour l’achat de locaux et de matériels).
En ce qui concerne le crédit à la consommation, la convention AERAS permet d’avoir une assurance emprunteur sans examen de l’état de santé si:

–  vous êtes âgé au maximum de 50 ans
–  la durée du crédit est inférieure ou égale à 4 ans
–  le montant cumulé de vos crédits entrant dans cette catégorie ne dépasse pas 17 000 euros
– vous signez une déclaration sur l’honneur de non cumul de prêts au-delà du plafond de 17 000 euros

En ce qui concerne les prêts immobiliers et professionnels , la convention AERAS permet d’avoir une assurance emprunteur après le processus suivant.

Si l’état de santé du demandeur ne lui permet pas d’être assuré aux conditions standard du contrat, son dossier sera automatiquement examiné, sans démarche particulière de sa part, à un deuxième niveau, par un service médical spécialisé.

A l’issue de cet examen, si une proposition d’assurance ne peut pas être établie, le dossier de l’emprunteur sera transmis, toujours sans intervention de sa part, à un troisième niveau,si :

• le montant cumulé de ses prêts ne dépasse pas 320 000 euros ( En cas d’achat d’une résidence principale, ce montant ne tient pas compte des crédits relais)
• l’emprunteur aura 70 ans au plus en fin de prêt

Par rapport à un contrat d’assurance standard, le tarif sera peut-être plus important et/ou les garanties parfois limitées.

Dans tous les cas, l’assureur informe le demandeur, par courrier, de sa décision :  acceptation ou refus d’assurance, l’ajournement, limitation ou exclusion de garantie, majoration éventuelle du tarif. Il mentionne aussi l’existence et les coordonnées de la commission de médiation AERAS, ainsi que le niveau d’examen auquel le refus est intervenu.

En cas de refus d’assurance, l’établissement de crédit examinera avec l’emprunteur les possibilités de garanties alternatives (cautions, hypothèques, …).

Les questionnaires de santé utilisés par AERAS sont de 2 types. Il y a le questionnaire simple et le questionnaire détaillé par pathologie qu’il est difficile de remplir sans l’aide d’un médecin.

Les professionnels de l’assurance et de la banque se sont engagés à répondre aux demandes de prêt immobilier dans un délai global de 5 semaines, dont 3 semaines pour l’assurance, à compter de la réception du dossier complet.

En cas de litige, l’emprunteur peut contacter la commission de médiation de la convention AERAS, 61 rue Taitbout, 75009 PARIS

Sinon pour bénéficier des dispositifs de la convention AERAS et pour emprunter quand on est malade, il faut contacter le référent AERAS qui existe au sein de chaque banque et organisme financier.

Le référent AERAS est le spécialiste du dispositif AERAS désigné au sein de chaque établissement de crédit. Il intervient soit en appui du conseiller, soit en répondant directement aux questions des candidats à l’emprunt.
